1. Introduction

Welcome to Flexi-Retail ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website located at flexiretail.co.za and our retail pod booking platform (together or individually "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

• "Platform" refers to the Flexi-Retail website and booking system.
• "Tenant" refers to any individual or business that books a retail pod through our Platform.
• "Landlord" refers to property owners who list retail pods on our Platform.
• "Pod" refers to a retail space unit available for booking.
• "Booking" refers to a confirmed reservation of a Pod for a specified period.

3. Account Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security of your password and accept all risks of unauthorized access.
• Immediately notify us if you discover any security breaches related to your account.

4. Booking Terms

4.1 Booking Process

All bookings are subject to availability and confirmation. A booking is only confirmed once payment has been successfully processed and you receive a confirmation email.

4.2 Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices are subject to change without notice, but confirmed bookings will be honored at the price quoted at the time of booking.

4.3 Payment

Payment must be made in full at the time of booking. We accept credit cards, debit cards, and EFT payments through our secure payment processor (Paystack).

5. Cancellation and Refund Policy

• More than 7 days before start date: Full refund minus 10% administration fee.
• 3-7 days before start date: 50% refund.
• Less than 3 days before start date: No refund.
• No-show: No refund will be provided.

Refunds will be processed within 7-14 business days to the original payment method.

6. Tenant Responsibilities

As a Tenant, you agree to:

• Use the Pod only for lawful retail activities.
• Maintain the Pod in good condition during your booking period.
• Comply with all applicable laws, regulations, and mall rules.
• Not sublet or transfer your booking to another party without written consent.
• Vacate the Pod by the end of your booking period.
• Report any damages or issues immediately to management.
• Obtain all necessary permits and licenses for your business activities.

7. Prohibited Activities

You may not use the Pod for:

• Sale of illegal, counterfeit, or prohibited goods.
• Activities that create a nuisance or disturbance.
• Storage of hazardous materials.
• Any activity that violates local laws or regulations.
• Activities that may damage the reputation of Flexi-Retail or the property.

8. Liability and Insurance

Flexi-Retail acts as a booking platform and is not responsible for:

• Loss, theft, or damage to your goods or equipment.
• Personal injury occurring on the premises.
• Business losses or interruptions.
• Actions of other tenants or visitors.

We strongly recommend that all Tenants obtain appropriate business insurance coverage.

9. Intellectual Property

The Flexi-Retail name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Flexi-Retail (Pty) Ltd. You may not use such marks without our prior written permission.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be governed by the laws of the Republic of South Africa. You agree to first attempt to resolve any disputes through good-faith negotiation. If negotiation fails, disputes shall be submitted to arbitration in Johannesburg, South Africa.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
